Trustee

Effective as of September 14, 2007 PNC Bank National Association (PNC Bank), a national banking association organized and existing under the laws of the United States, assumed Trusteeship of the BIT.  PNC Bank is wholly owned by The PNC Financial Services Group Inc., which is headquartered in Pittsburgh, PA. PNC Realty Investors, Inc. is responsible for the administration, management, and investment decisions of the BIT.

The assumption of Trusteeship by PNC followed the merger on March 2, 2007 of the parent companies of PNC Bank and Mercantile-Safe Deposit and Trust Company, which had served as BIT Trustee since 1992.

PNC Bank, as trustee, is a fiduciary to the participants in the BIT pursuant to Employee Retirement Income Securities Act of 1974 as amended (“ERISA”).  PNC Bank currently qualifies as a “Qualified Professional Asset Manager”, as defined under V(a) of Prohibited Transaction Class Exemption of ERISA, and also qualifies for Class Exemption 91-38 of ERISA regarding bank collective investment funds.

PNC, with a history that dates back more than 150 years, is a diversified financial services company with business engaged in retail banking, corporate and institutional banking, asset management, and global fund processing services, with consolidated total assets of $125.7 billion and consolidated shareholders’ equity of $14.5 billion at June 30, 2007.  PNC’s portfolio of loans secured by real estate exceeds $10 billon on a consolidated basis.
